What is the 40% FGTS penalty for dismissal?
When an employee is dismissed without just cause (demissão sem justa causa), the employer must pay a 40% fine on the entire FGTS balance accumulated during employment. This fine goes directly to the employee. If the dismissal goes through the court (demissão por acordar), only 20% applies.
